Welcome, and thank you for your interest in DishDetect, a food recognition platform operated by DEPLOY EVERYWHERE (Pty) Ltd. These Terms of Service govern your access to and use of our AI-powered food identification service.

1. Acceptance of Terms

By accessing and using DishDetect, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

1.1 Definitions

Throughout these Terms of Service, the following terms have the meanings set forth below:

"Service" refers to the DishDetect application, website, and all related features, tools, and functionalities provided by DEPLOY EVERYWHERE (Pty) Ltd.
"User," "You," or "Your" refers to any individual who accesses or uses the Service, including account holders and visitors.
"Content" refers to any images, text, recipes, nutritional information, or other materials uploaded, generated, or displayed through the Service.
"Account" refers to your registered user account that provides access to the Service's features.
"Library" refers to your personal collection of identified dishes, recipes, and saved content within the Service.
"Explore" refers to the public discovery feature where users may optionally share their identified dishes and recipes with the community.
"Subscription" refers to paid access plans that provide premium features, including auto-renewable subscription options.
"Third-Party Platforms" refers to external services that distribute the application and process payments, including app stores and payment processors.
"Company," "We," "Us," or "Our" refers to DEPLOY EVERYWHERE (Pty) Ltd, the operator of DishDetect.

2. Description of Service

DishDetect is an AI-powered food recognition service that identifies dishes from uploaded images and provides recipe information. We use foundational top-tier models and LLMs from third-party providers, combined with our own proprietary algorithms, to deliver the best possible dish identification and recipe suggestions. We strive to provide accurate dish identification, but cannot guarantee 100% accuracy. Users are responsible for verifying recipe information before use.

3. Eligibility; Age Requirements

By accessing or using the DishDetect Service, you represent and warrant that you are at least 13 years old and legally permitted to use the Service in your jurisdiction.

If you are under 18 years old, you further represent that you have obtained the consent of a parent or legal guardian and that such parent or guardian acknowledges and accepts responsibility for your use of the Service, including any activities performed through your account.

4. Content and Use

Your Content

• You retain full ownership of images you upload
• Images are stored in your personal library to provide access to your identified dishes and recipes
• We do not claim ownership of your uploaded content
• You may delete images from your library at any time
• Disabling Explore sharing applies only to new uploads; previously shared content will remain visible unless removed by you or in accordance with these Terms

Public Explore Features (Opt-In)

You may choose to share your uploaded images and identified recipes to our public Explore page. Sharing to Explore is entirely optional and controlled by you in Settings.

When Explore sharing is enabled:

• New uploads will automatically appear on the public Explore page
• Other users can view and discover your shared recipes
• Your username may be displayed with your shared content

When Explore sharing is disabled:

• New uploads will remain private in your personal library only
• Previously shared content will remain on Explore unless removed by our moderation team
• To request removal of your content from Explore, contact our support team via the support page or email support@dishdetect.app
• Removal requests are processed immediately (content hidden within minutes) and reviewed within 24 hours

You can enable or disable Explore sharing at any time in your account Settings. We reserve the right to remove content from Explore that violates these terms.

Use Restrictions

• Do not upload inappropriate, offensive, or illegal content
• Respect copyright and intellectual property rights of others
• Do not use the service for harassment or malicious purposes
• Content shared to Explore must comply with community guidelines
• We reserve the right to remove content that violates these terms

AI Processing and Limitations

DishDetect uses automated systems to analyze uploaded images and generate dish identifications, recipe information, and other insights. These automated results may not always be accurate, complete, or appropriate for all situations.

You understand and agree that:

• Automated outputs may contain errors or omissions
• Results should not be relied upon as professional advice of any kind
• You are responsible for evaluating the accuracy and suitability of all information provided by the Service
• The Service may incorporate technologies or services provided by third parties, which may have their own limitations or biases

DishDetect does not guarantee the accuracy of any identification, recipe suggestions, nutritional information, or other automated outputs generated through the Service.

Health, Nutrition, and Safety Disclaimers

DishDetect provides automated dish identification and recipe suggestions for general informational purposes only. The Service does not provide medical, nutritional, or professional dietary advice.

You acknowledge and agree that:

• Any nutritional details, ingredient suggestions, or recipe information generated by the Service are estimates and may be inaccurate or incomplete
• The Service is not intended to diagnose, treat, cure, or prevent any illness or medical condition
• Individuals with dietary restrictions, allergies, or health concerns should consult a licensed healthcare or nutrition professional before relying on any information provided through the Service
• You are solely responsible for verifying ingredient safety, preparation methods, and any dietary suitability of foods you choose to consume
• The Company is not liable for inaccurate identifications, recipe errors, or any adverse outcome related to food preparation or consumption

5. Intellectual Property

DEPLOY EVERYWHERE (Pty) Ltd owns all rights to the DishDetect service, our proprietary algorithms, and our own AI models. We also utilize foundational top-tier models and LLMs from third-party providers to enhance our service. Users retain rights to their uploaded images and generated content. We may use anonymized data to improve our services.

6. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy for detailed information on data collection and usage.

Image Storage and Retention

• Uploaded images are securely stored to provide you access to your identified dishes and recipes
• Images remain in your personal library until you delete them
• Deleting an image from your library removes it from your personal access immediately

Important: Explore Content Visibility

If you have Explore sharing enabled, your images may appear on the public Explore page. Images on Explore remain publicly visible even if you:

• Delete them from your personal library
• Disable Explore sharing in Settings (only affects new uploads)

To remove previously shared images from the public Explore page, contact our support team at support@dishdetect.app or via the in-app support page. Removal requests are processed immediately with content hidden within minutes, and all requests are reviewed and confirmed within 24 hours.

Complete account deletion removes all your personal data including all images from both your library and Explore.

Content Moderation

• Users may report inappropriate content on Explore by clicking "Report" on any image
• Reported content is immediately removed from public view pending review
• We review all reports within 24 hours
• You may request removal of your own content from Explore at any time by contacting support
• Repeated violations may result in content removal, account suspension, or termination
• You may appeal content moderation decisions by contacting support

Data Protection

• We implement industry-standard security measures to protect your personal information
• We comply with the Protection of Personal Information Act (POPIA)
• Your data is processed in accordance with our Privacy Policy
• We ensure that any third-party service providers involved in processing data on our behalf adhere to data protection standards that are at least as strict as those required under POPIA, GDPR, or other applicable international privacy regulations
• Customer support is available via our support page during business hours

We comply with applicable global data protection laws, including POPIA, GDPR where applicable, and comparable international privacy regulations.

7. Service Availability

We reserve the right to modify, suspend, or discontinue the service at any time. We implement security measures to protect your personal information and provide customer support as needed.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DEPLOY EVERYWHERE (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or personal harm arising out of or related to your use of the DishDetect service.

Where liability cannot be excluded, the total cumulative liability of DEPLOY EVERYWHERE (Pty) Ltd for any claim arising from or relating to the Service shall not exceed the greater of:

• The total amount you paid, if any, for access to the Service during the twelve (12) months preceding the event giving rise to the claim, or
• One thousand five hundred South African Rand (ZAR 1,500)

You acknowledge that the Service is provided "as is" and "as available," and you agree that your use of the Service is at your sole risk. Users are responsible for verifying recipe information, food preparation, and nutritional decisions.

9. Termination

We may terminate or suspend your account for violations of these terms. Upon termination, your right to use the service ceases immediately. All provisions that should survive termination will remain in effect.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of DishDetect will be subject to the exclusive jurisdiction of South African courts. We comply with applicable South African laws including the Protection of Personal Information Act (POPIA) and the Consumer Protection Act.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or service notifications. Continued use constitutes acceptance of modified terms.

12. Subscription and Billing Terms

DishDetect offers auto-renewable subscription plans that provide access to premium features. By purchasing a subscription, you agree to the following:

Payment Processing

Payments, billing, renewals, and refunds for in-app purchases and subscriptions are handled by third-party platforms that distribute the application. These platforms manage all payment transactions and related policies.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Renewal Charges

Your account will be charged for renewal within 24 hours before the current billing period ends at the price shown for your selected plan.

Managing or Canceling Subscriptions

You may manage or cancel your subscription at any time through the account settings of the third-party platform where you purchased the subscription.

Refunds

Refunds for subscriptions or in-app purchases are governed by the refund policies of the third-party platform. DishDetect cannot issue refunds directly.

Access After Cancellation

If you cancel, you retain access to premium features until the end of your current billing period.

13. License Grant and Third-Party Terms

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the DishDetect application and its features for personal, non-commercial purposes, subject to these Terms and any applicable third-party terms that may apply when accessing or purchasing features within the Service.

Certain features of the Service may rely on integrations, technologies, or services provided by third parties. Your use of those features may be subject to additional terms, conditions, or policies imposed by those third parties, and you agree to comply with all applicable third-party requirements.

Nothing in these Terms grants you ownership of the DishDetect application or its underlying technology. All rights not expressly granted to you are reserved.

14. Copyright Complaints

If you believe that any content available through the Service infringes your copyright or other intellectual property rights, you may notify us at legal@dishdetect.app. Your notice should include:

• A description or link to the content you believe is infringing
• Proof that you own the rights or are authorized to act on behalf of the owner
• The location of the infringing material within the Service
• Your contact information

We will review all valid notices and take appropriate action in accordance with applicable laws.
